The separation period for divorce in Virginia varies depending on several factors.

In general, Virginia divorce law requires you to be separated for at least 1 year before your divorce can be granted.

If a divorce is granted on the grounds of adultery, there is no waiting period of separation required under Virginia law. All other fault grounds require a separation period of 1 year before a divorce can be granted.

A couple may be divorced after a 6 month separation if they have no children and they have executed a written legal separation agreement
